03 / PRIORITY FINDING / CR-02

CR-02 Self-representation and penalty

RED / ACTION REQUIRED · CLAUSES 4.1–4.2

FICTIONAL CONTRACT / ABRIDGED EXCERPT

“During the Term, the Player shall not negotiate or conclude an employment agreement with a Dutch club without the Agent’s involvement, even if the Player wishes to represent himself. […] A breach of article 4.1 shall result in a fixed contractual penalty of EUR 7,500 […].”

Why is this an issue?

These KNVB provisions protect self-representation in the relevant Dutch negotiations. A penalty for doing so is prohibited; only special circumstances may justify compensation.

What does this mean for you?

The wording tries to stop you negotiating with a Dutch club yourself. The €7,500 penalty may discourage you from making your own choice.

WHAT

Remove the prohibition on self-representation and the automatic penalty.

WHY

To preserve your freedom to negotiate and align the terms with the applicable regulations.

05 / LEGAL BASIS & LIMITATIONS

Legal basis and limitations

01

The reviewed agreement

Fictional agent agreement, draft dated 15 October 2026, 12 clauses. Domestic transactions with Dutch clubs are assumed.

02

The source for CR-02

KNVB Reglement Voetbalagenten, July 2026, article 3(4)–(5). Report date: 15 October 2026.

03

The legal distinction

A conflict with regulations does not automatically establish nullity or voidability under civil law. An actual matter requires its own assessment of the facts, law and any exceptions.

All parties and terms in this example are fictional. Not advice for an actual client.

WHEN TO REVIEW

Before signing.
Or after signing.

Before signing

We assess your rights, obligations and the legal meaning of the terms. Where needed, you receive specific questions or proposed changes to discuss before signing.

An existing agreement

A signed contract can also be reviewed. The report then focuses on existing commitments and the room within them. The pre-signing example above is not used unchanged for that review.

Playing agreements, agent agreements, sponsorship, image rights and other suitable contracts. Dispute handling and dealing with a counterparty are outside Contract Review.

Practical questions

Does this include handling a dispute?

No. Contract Review is an assessment product. Advice on a dispute or further legal assistance is considered as a separate engagement.

Can a parent make an enquiry?

Yes. The athlete is the client. Authority, any required consent for minors and conflicts are checked before engagement.

What does a review cost?

The fixed fee depends on agreed scope and complexity. The total is confirmed before work begins.
